我国跨境破产判决承认与协助问题研究

A Study on the Issues Concerning the Recognition and Assistance of Cross-Border Insolvency Judgments in China

摘要: 随着改革开放的不断扩大，我国不断开拓国际市场，国际合作加强，跨境破产案件逐渐增多，引起了国家的重视以及学界的广泛讨论。我国跨境破产制度起步于上世纪90年代，直至21世纪初制定出具体的法律条文，即《中华人民共和国企业破产法》，其第五条针对跨境破产案件做出了规定，但仅仅是原则性规定，实践中不利于司法活动的展开，因此以我国现存问题为导向，结合以往司法实践案例和相关域外立法经验，对我国跨境破产与协助制度研究，确定我国关于跨境破产案件承认与执行的立场，并提出完善具体并且有可行性的跨境破产承认与协助的相关建议。

Abstract: With the continuous expansion of the reform and opening-up policy, China has steadily explored the international market, strengthened international cooperation, and witnessed a gradual increase in cross-border insolvency cases, which has attracted national attention and extensive discussions in academic circles. China’s cross-border insolvency system originated in the 1990s, and specific legal provisions were formulated in the early 21st century, namely the Enterprise Bankruptcy Law of the People’s Republic of China. Article 5 of this law regulates cross-border insolvency cases, but these are merely principled provisions that are not conducive to the conduct of judicial activities in practice. Therefore, guided by existing problems in China, combined with previous judicial practice cases and relevant foreign legislative experience, this paper studies China’s cross-border insolvency and assistance system, clarifies China’s stance on the recognition and enforcement of cross-border insolvency cases, and puts forward specific and feasible suggestions for improving cross-border insolvency recognition and assistance.
