电商预售法律风险与消费者权益保护研究
Legal Risks and Consumer Rights Protection in E-Commerce Pre-Sales
摘要: 随着电子商务的蓬勃发展,预售模式已成为商家提前锁定客户、测试市场反应、缓解资金压力的重要营销策略。然而,这种“先付款、后生产”的交易模式在带来便利与优惠的同时,也因其交易的时空分离性、信息不对称性以及合同内容的复杂性,引发了诸多新型法律风险,对传统消费者权益保护法律体系构成了严峻挑战。本文旨在系统剖析电商预售模式的基本法律关系,识别其运行过程中潜藏的法律风险,并探讨以平台为主的消费者权益保障设想,以促进电商预售模式的健康与可持续发展。
Abstract: With the rapid development of e-commerce, the pre-sale model has become an important marketing strategy for businesses to secure customers in advance, test market reactions, and alleviate financial pressure. However, while this “payment first, production later” transaction model brings convenience and discounts, it also introduces numerous new legal risks due to the separation of transaction time and space, information asymmetry, and the complexity of contract terms. These challenges pose significant threats to the traditional legal framework of consumer rights protection. This paper aims to systematically analyze the fundamental legal relationships in e-commerce pre-sale models, identify the latent legal risks during their operation, and explore platform-centric approaches to safeguarding consumer rights, thereby promoting the healthy and sustainable development of e-commerce pre-sale models.
