电商预售模式下合同性质的认定——以小众服装类商品为例
The Identification of Contract Nature under the E-Commerce Pre-Sales Model—A Case Study of Niche Clothing Products
摘要: 随着电子商务的迅猛发展,预售模式逐渐成为电商平台销售小众服装类商品的重要手段。特别是对于具有定制化、限量生产等特点的小众服装,预售模式不仅帮助商家实现精准的市场预测和生产调度,还能为消费者提供个性化的购物体验。然而,小众服装预售合同的法律性质尚未得到充分明确,现有法律条文难以完全适用于此类商品的交易特点。本文通过分析小众服装电商预售的商业逻辑与法律特征,结合相关法律条文,探讨了小众服装预售合同的性质,并提出了适合该模式的法律认定标准。
Abstract: With the rapid development of e-commerce, the pre-sales model has gradually become an important means for e-commerce platforms to sell niche clothing products. Particularly for niche clothing characterized by customization and limited production, this model not only helps merchants achieve accurate market forecasting and production scheduling but also provides consumers with personalized shopping experiences. However, the legal nature of pre-sales contracts for niche clothing has not been fully clarified, and existing legal provisions struggle to fully adapt to the transaction characteristics of such products. This paper will explore the nature of such pre-sales contracts and propose appropriate legal identification standards for this model integrating with relevant legal provisions by analyzing the commercial logic and legal features of e-commerce pre-sales for niche clothing.
