Protecting the Labor Rights & Interests of Gig Workers in the Context of the Sharing Economy

摘要: 共享经济背景下就业形态的重大转变，给劳动者带来就业灵活性的同时，劳动关系也面临着深刻调整，引发诸多有关网约工劳动权益保障问题。为维护网约工正当权益，在遵循倾斜保护、提升组织化程度与建立多方合作等原则基础上，有必要提高网约工的自我保护意识、强化企业社会责任和行业自律机制、完善现行劳动法律法规、加大政策支持和政府监管以及充分发挥工会作用。

Abstract: Under the background of sharing economy, the major change of employment form brings employment flexibility to workers, and labor relations are also facing profound adjustment, causing many problems about the protection of labor rights & interests of gig workers. In order to safeguard the legitimate rights and interests of gig workers, it is necessary to follow the principles of slanted protection, improve the degree of organization and establish multi-party cooperation, and take measures such as improving the self-protection awareness of gig workers, strengthening corporate social responsibility and industry self-discipline mechanism, improving existing labor laws and regulations, increasing policy support and government supervision, and giving full play to the role of trade unions.
