劳动者维权成本赔偿机制研究——以律师费转付为切入点

Research on the Compensation Mechanism for Workers’ Rights Protection Costs—Starting with the Shifting of Attorney Fees

摘要: 在我国现行劳动争议解决制度中，维权成本问题日益成为劳动者获得公正救济的重要障碍。尽管劳动法确立了劳动者权益保护的基本制度框架，但实践中，劳动者因维权所付出的经济、时间及心理成本，常常超过其应得权益本身，特别是在仲裁未果、进入诉讼程序后。这种现象既削弱了法律救济的实际效能，也损害了社会对司法公正的信任基础。本文以典型劳动争议案件为例，梳理劳动者在维权过程中面临的多维成本，分析当前制度缺陷，提出通过完善律师费转付制度、建立合理赔偿标准及优化法律援助机制来有效回应劳动者的实际困境，从而推动形成权责对等、公平正义的劳动争议解决体系。

Abstract: Within China’s current labor dispute resolution system, the issue of rights protection costs is increasingly becoming a significant obstacle for workers seeking fair redress. Although labor law establishes a fundamental institutional framework for protecting workers’ rights, in practice, the economic, temporal, and psychological costs incurred by workers during the process of safeguarding their rights often exceed the value of the entitlements they seek. This is particularly true when disputes proceed from unsuccessful arbitration to litigation. This phenomenon not only undermines the practical effectiveness of legal remedies but also erodes societal trust in the foundation of judicial fairness. Using typical labor dispute cases as examples, this paper categorizes the multi-dimensional costs faced by workers during rights protection, analyzes the shortcomings of the current system, and proposes measures such as refining the attorney fee-shifting system, establishing reasonable compensation standards, and optimizing legal aid mechanisms. These proposals aim to effectively address the practical difficulties faced by workers, thereby promoting the development of a fair, just, and balanced labor dispute resolution system where rights and responsibilities are appropriately aligned.
