电商平台消费者个人信息保护路径研究

摘要: 随着电子商务的迅猛发展,电商平台已成为消费者日常生活不可或缺的一部分。消费者在享受电商平台提供便捷服务的同时,也面临着个人信息侵权等一系列严峻挑战。目前,我国虽然有《中华人民共和国网络安全法》(以下简称《网络安全法》)、《中华人民共和国电子商务法》《中华人民共和国个人信息保护法》(以下简称个人信息保护法》以及新出台的《中华人民共和国消费者权益保护法实施条例》等多部法律对电商平台消费者个人信息有所涉及,但电子商务是依托互联网技术进行商品交易及相关服务的经营活动,电子商务的发展改变了传统的线下购物方式。在此背景下产生的电商平台消费者个人信息保护存在以下问题:一是电商平台收集处理消费者个人信息的界限模糊、二是电商平台消费者个人信息保护的法律滞后和执法效能双重制约、三是电商平台消费者自主维权困难。本文针对以上问题,提出明确电商平台消费者个人信息收集保护标准、健全电商平台消费者权益保护立法和执法体系、完善电商平台消费者个人信息保护维权渠道等三个解决路径,以便更有效地保护消费者合法权益,激发市场活力,促进经济的发展。
Abstract: With the rapid development of e-commerce, online platforms have become an indispensable part of consumers’ daily lives. While enjoying the convenient services provided by e-commerce platforms, consumers also face a series of serious challenges, including personal information infringement. Currently, although China has several laws, such as the Cybersecurity Law of the People’s Republic of China (hereinafter referred to as the Cybersecurity Law), the E-commerce Law of the People’s Republic of China, the Personal Information Protection Law of the People’s Republic of China (hereinafter referred to as the Personal Information Protection Law), and the newly introduced Regulations on the Implementation of the Consumer Rights and Interests Protection Law of the People’s Republic of China, which address the protection of consumers’ personal information on e-commerce platforms, e-commerce, as a business activity relying on internet technology for product transactions and related services, has transformed traditional offline shopping methods. Against this backdrop, the protection of consumers’ personal information on e-commerce platforms faces the following issues: first, the boundaries for the collection and processing of consumers’ personal information by e-commerce platforms are vague; second, there is a dual constraint of lagging legislation and ineffective enforcement in the protection of consumers’ personal information on e-commerce platforms; and third, consumers face difficulties in independently safeguarding their rights on e-commerce platforms. To address these issues, this paper proposes three solutions: clarifying the standards for the collection and protection of consumers’ personal information on e-commerce platforms, improving the legislative and enforcement systems for the protection of consumers’ rights and interests on e-commerce platforms, and enhancing the channels for consumers to protect their personal information on e-commerce platforms. These measures aim to more effectively safeguard the legitimate rights and interests of consumers, stimulate market vitality, and promote economic development.
