互联网中名誉权保护的现实困境与破解

The Practical Dilemma and Solving of the Protection of Reputation Rights on the Internet

摘要: 随着互联网的普及，网络侵权现象日渐突出，通过对互联网中名誉权的保护进行研究，对名誉权相关概念进行介绍，分析互联网中侵犯名誉权所具有的特征，体现出互联网的众多特质赋予了名誉权侵权不同于传统名誉权侵权的特殊性。对互联网中名誉权保护的现状及局限性进行阐述，分析我国互联网中名誉权保护现阶段存在的主要问题，结合我国国情和司法实践经验，在此基础上引发对其完善保护的个人思考，使互联网中名誉权的保护愈发完善。

Abstract: With the widespread use of the Internet, incidents of online infringement have become increasingly prominent. By studying the protection of reputation rights on the Internet, this research introduces related concepts of reputation rights, analyzes the characteristics of reputation rights violations online, and highlights that the unique features of the Internet give such infringements distinct differences from traditional reputation rights violations. The current status and limitations of protecting reputation rights online are discussed, and the main issues in the current protection of online reputation rights in China are analyzed. By combining the national conditions and judicial practice experience of China, this study also offers personal reflections on improving such protection, aiming to make the protection of reputation rights on the Internet more comprehensive.
