电商领域中消费者评价权保护问题研究
Research on the Protection of Consumer Evaluation Rights in the E-Commerce Field
摘要: 在电商发展如火如荼的当下,网络交易早已成为主流的消费方式,消费者在网购选品时,已然习惯于根据其他购买者的评价来对商品与服务作出初步判断。消费者评价机制如能正常运行,则在促进消费决策、弥补公权监管以及保障电商行业健康发展等诸多方面都能给予大力支持。然而,在我国现有的市场经济环境下,消费者评价权正面临着一定程度的侵害。本文以网络交易中的消费者评价权为切入点,深入分析消费者评价权的理论演进、属性及相关权利辨析、权利分类,针对我国消费者评价权保护的现状和治理困境,探索构建消费者评价权保护机制,为提高消费者评价权保护效能提供有效途径,以期促进网络交易市场的健康发展。
Abstract: In the current booming development of e-commerce, online transactions have become the mainstream way of consumption. Consumers have become accustomed to making preliminary judgments about goods and services based on the evaluations of other buyers when choosing products online. If the consumer evaluation mechanism can operate normally, it can provide strong support in promoting consumer decision-making, compensating for public supervision, and ensuring the healthy development of the e-commerce industry. However, in the current market economy environment in China, consumer evaluation rights are facing a certain degree of infringement. This article takes the consumer evaluation right in online transactions as the starting point, and deeply analyzes the theoretical evolution, attributes, and related rights differentiation and classification of consumer evaluation right. In response to the current situation and governance difficulties of consumer evaluation right protection in China, it explores the construction of a consumer evaluation right protection mechanism to provide effective ways to improve the effectiveness of consumer evaluation right protection and promote the healthy development of the online transaction market.
