跨境电商中消费者权益保护问题研究
Research on the Protection of Consumer Rights and Interests in Cross-Border E-Commerce
摘要: 随着互联网技术的快速发展和全球贸易格局的深刻变革,跨境电商已成为推动经济发展的重要力量,其在促进商品与服务跨国流动的同时,也带来了消费者权益保护方面的新挑战。当前,跨境电商消费者在交易过程中常面临信息不对称、维权渠道不畅、跨境争端解决困难等问题,这些问题严重制约了行业的健康发展。本文在梳理跨境电商消费者权益保护相关理论的基础上,系统分析了国内外相关法律制度的现状与不足,指出当前法律体系在适用性、执行机制与国际协作等方面存在明显短板。针对这些困境,研究从立法完善、监管机制创新、国际合作深化等维度提出构建多主体协同、全流程覆盖的消费者权益保障体系。通过强化平台责任、优化纠纷解决机制、推动数据合规流动等具体路径,有望显著提升消费者信任度与满意度,为跨境电商持续健康发展营造更加公平、安全的环境。未来,应进一步关注数字技术发展对消费模式的影响,持续完善适应新型业态的权益保护机制。
Abstract: With the rapid development of internet technology and profound shifts in the global trade landscape, cross-border e-commerce has emerged as a significant force driving economic growth. While facilitating the international flow of goods and services, it has also introduced new challenges in consumer rights protection. Currently, consumers in cross-border e-commerce transactions frequently encounter issues such as information asymmetry, ineffective redress channels, and difficulties in resolving cross-border disputes, which severely hinder the healthy development of the industry. Based on a review of relevant theories concerning consumer rights protection in cross-border e-commerce, this paper systematically analyzes the current state and shortcomings of related legal systems domestically and internationally, highlighting significant gaps in applicability, enforcement mechanisms, and international cooperation within the existing legal framework. To address these challenges, the study proposes the construction of a multi-stakeholder, full-process consumer rights protection system from the perspectives of legislative refinement, regulatory innovation, and deepened international collaboration. By strengthening platform accountability, optimizing dispute resolution mechanisms, and promoting compliant cross-border data flow, it is anticipated that consumer trust and satisfaction will be significantly enhanced, fostering a fairer and safer environment for the sustainable and healthy development of cross-border e-commerce. Future efforts should further focus on the impact of digital technology advancements on consumption patterns and continuously improve rights protection mechanisms adapted to new business models.
