调解前置导向下的多元化机制：国际商事争端解决的创新探索与实践路径

Mediation-Oriented Precedent: Innovative Exploration and Practical Pathways for Diversified Mechanisms in International Commercial Dispute Resolution

摘要: 本文以中国在国际商事争端解决领域的创新实践为研究对象，系统梳理其融合传统“和合”智慧与现代法治理念的路径创新。通过构建“调解–仲裁–司法”三位一体的多元化纠纷解决机制(ADR)，结合“一带一路”国际商事调解中心、深圳国际仲裁院等典型案例，论证中国方案对优化全球营商环境、推动国际规则重构的实践价值。研究揭示，中国模式在效率提升、成本控制和文化包容性方面具有显著优势，但亦面临国际认可度不足、规则衔接不畅等挑战。最后提出构建“智慧争端解决生态圈”的展望，为全球治理体系变革提供中国范式。

Abstract: This paper takes China’s innovative practices in the field of international commercial dispute resolution as the research object, systematically examining the path of innovation that integrates traditional “harmony” wisdom with modern rule-of-law concepts. By constructing a “mediation-arbitration-judicial” trinity of diversified dispute resolution mechanisms (ADR), and analyzing typical cases such as the “Belt and Road” International Commercial Mediation Center and the Shenzhen Court of International Arbitration, the study demonstrates the practical value of the Chinese approach in optimizing the global business environment and promoting the reconstruction of international rules. The research reveals that the Chinese model has significant advantages in improving efficiency, controlling costs, and cultural inclusivity, but also faces challenges such as insufficient international recognition and poor rule alignment. Finally, it proposes a vision for building a “smart dispute resolution ecosystem” to provide a Chinese paradigm for global governance system reform.
