劳动法视角下民营企业灵活用工模式的法律风险及对策研究

摘要: 在灵活用工日益普及的背景下,民营企业因管理不规范、制度不完善等问题频发劳动法律风险。本文从劳动法视角出发,剖析灵活用工模式的法律属性,归纳合同管理缺失、缴纳社保不到位等风险类型,阐述了当前民营企业在合规防控中面临的现实困境。进一步提出从强化合规意识、完善用工制度、健全合同文本与待遇保障等方面入手,构建多部门协同的劳动合规管理体系,为企业合法用工提供可行性路径,也为劳动者权益保护提供法治保障。
Abstract: Against the backdrop of increasingly prevalent flexible employment, private enterprises frequently encounter labor law risks due to issues such as irregular management and imperfect systems. From a labor law perspective, this paper analyzes the legal attributes of flexible employment models, categorizes risk types including contract management deficiencies and inadequate social insurance contributions, and elaborates on the practical challenges currently faced by private enterprises in compliance prevention and control. It further proposes a multi-department collaborative labor compliance management system by strengthening compliance awareness, improving employment systems, refining contract templates, and enhancing benefits protection, providing feasible pathways for lawful employment and offering legal safeguards for workers’ rights.
