电商平台与主播间劳动关系法律认定研究——基于新就业形态劳动关系的认定困境与完善路径
Research on the Legal Identification of Labor Relations between E-Commerce Platforms and Streamers—Identification Dilemma and Improvement Path of Labor Relations in the New Employment Forms
摘要: 数字经济持续发展使电商平台与网络主播间劳动关系的认定日益复杂。作为新就业形态的核心群体之一,网络主播的用工模式呈现灵活化、多元化以及虚拟化等鲜明特征,传统标准难以认定新情况。本文通过剖析电商平台的用工特点以及劳动关系认定过程中存在的各类困境,梳理该领域的理论争议与司法实践发展趋势,构建起以实质从属性为核心的类型化认定体系。研究表明,相关争议的产生大多源于对实质从属性这一核心要素的理解存在差异。本文结合典型案例,从立法、司法、行政三个维度提出针对性的完善建议,打造立法引领、司法保障、行政监管、行业自律协同发力的多元治理格局,以期保障新就业形态下劳动者的法律权益。
Abstract: The continuous development of the digital economy has increasingly complicated the identification of labor relations between e-commerce platforms and online streamers. As one of the core groups in the new employment forms, online streamers are featured by flexible, diversified and virtual employment modes, which can hardly be identified by traditional standards. By analyzing the employment characteristics of e-commerce platforms and various dilemmas in the identification of labor relations, this paper sorts out the theoretical disputes and the development trend of judicial practice in this field, and constructs a typed identification system centered on subordinate attributes in substance. The research shows that most relevant disputes arise from divergent understandings of the core element—subordinate attributes in substance. Combined with typical cases, this paper puts forward targeted improvement suggestions from three dimensions: legislation, judicature and administration, so as to form a multi-governance pattern with the coordinated efforts of legislative guidance, judicial guarantee, administrative supervision and industry self-regulation, aiming to protect the legal rights and interests of workers under the new employment forms.
