拉美国家与中国签订的BIT比较分析——以投资保护为视角

Comparative Analysis of BITs Signed between Latin American Countries and China—From the Perspective of Investment Protection

摘要: 拉美地区资源丰富，是当前最具发展潜力的新兴地区之一，也是中国“一带一路”中的重要战略地区。我国与拉美国家签订的BIT数量较少，年代较久，许多条款规定过于笼统，且缺乏适时发展的新条款，与目前高速发展的双边经贸关系不相适应。本文谨就双边11个投资协定进行比较分析，为制度构建提供理论支持，同时为中国企业“走出去”在拉美地区投资提供建议。

Abstract: Latin America is a resource-rich region, one of the emerging regions with the greatest development potential, and an important strategic region in China’s “Belt and Road”. The number of BITs signed between China and Latin American countries is relatively small and old, and many of the provisions are too general and lack of timely development of new provisions, which are not compatible with the current rapid development of bilateral economic and trade relations. In this paper, we would like to make a comparative analysis of 11 bilateral investment agreements, to provide theoretical support for the construction of the system, and at the same time, to provide suggestions for Chinese enterprises to “go out” to invest in Latin America.
