电商平台专利侵权“通知–删除”规则的适用研究

Research on the Application of the “Notice-Takedown” Rule for Patent Infringement on E-Commerce Platforms

摘要: 随着电商平台专利侵权案件的频发，我国法学界开始试图将起源于著作权领域的“通知–删除”规则引入专利法中。本文旨在探讨电商平台专利侵权案件中“通知–删除”规则的适用性。首先，文章梳理了“通知–删除”规则在我国的立法与发展；探讨了将其引入专利领域的必要性和适用程序；文章还考察了我国电商平台在专利侵权审查方面的现状和面临的困境。最后，从电商平台和权利人的角度提出了完善建议，包括认可电商平台反通知前置流程和限制权利人恶意投诉，以期为电商平台专利侵权案件的处理提供参考。

Abstract: With the frequent occurrence of patent infringement cases on e-commerce platforms, China’s legal scholars have begun to try to introduce the “notice-takedown” rule, which originated in the field of copyright, into the patent law. The purpose of this article is to explore the applicability of the “notice-takedown” rule in patent infringement cases involving e-commerce platforms. Firstly, this paper reviews the legislation and development of the “notice-takedown” rule in China, discusses the necessity and application procedures of introducing it into the patent field, and examines the current situation and dilemmas faced by China’s e-commerce platforms in patent infringement review. Finally, from the perspective of e-commerce platforms and rights holders, some suggestions are put forward, including recognizing the pre-notification process of e-commerce platforms and restricting malicious complaints from right holders, in order to provide reference for the handling of patent infringement cases by e-commerce platforms.
