过程性信息的认定研究
Research on Identification of Process Information
摘要: 依法推进政府信息公开是建设法治政府的重要举措。新修订的《中华人民共和国政府信息公开条例》首次对过程性信息作出了可以不予公开的规定。但由于未明确规定过程性信息的涵义,导致司法实践中对过程性信息的认定存在困境,主要表现为“过程性”认定标准存在分歧,混淆过程性信息和内部事务信息。为了更准确地认定过程性信息,回应司法实践的现实需求,一方面要明确“过程性”认定标准,另一方面,要辨明过程性信息和内部事务信息的界限。
Abstract:
Promoting government information disclosure according to law is an important measure to build a government ruled by law. The newly revised Regulations of the People’s Republic of China on the Disclosure of Government Information has for the first time stipulated that process information may not be disclosed. However, because the meaning of process information is not clearly defined, there are difficulties in the identification of process information in judicial practice. The main manifestations are the differences in the identification standards of “process” and the confusion between process information and internal affairs information. In order to identify the process information better, on the one hand, it is necessary to clarify the “process” identification criteria, on the other hand, it is necessary to identify the boundary between process information and internal affairs information.
