平台用工模式下轴辐型算法共谋规制问题研究——以网约车为例

Research on the Regulation of Collusion in Hub-and-Spoke Algorithm within Platform Employment Mode—Taking Online Car-Hailing for Example

摘要: 网约车行业作为共享经济下的典型行业，能够作为平台用工模式轴辐型算法共谋的规制问题的研究对象。适用现有反垄断法规定进行规制时，网约车平台与司机间法律关系模糊、欠缺意思联络要件导致无法对共谋行为进行认定的难题，在进行法律责任分配时也会产生两难困境。为了有效规制网约车算法共谋行为，应秉承包容审慎监管理念，引入不完全劳动关系概念区分不同模式平台司机间法律关系，借鉴域外经验通过舍弃意思联络要件或者扩大解释认定共谋行为，在维护司机权益基础上合理分配法律责任。

Abstract: The online car-hailing industry, as a typical sector in the sharing economy, can serve as a research subject for examining the regulation of collusion in hub-and-spoke algorithm within platform employment mode. When applying existing provisions of anti-monopoly laws for regulation, the ambiguity of legal relationships between online car-hailing platforms and drivers, along with the lack of meaningful liaison elements, leads to challenges in identifying collusion behavior. This also results in dilemmas regarding the allocation of legal responsibility. In order to effectively regulate collusion behavior within online car-hailing algorithms, it is essential to uphold the concept of inclusive prudential supervision. Introducing the concept of incomplete labor relations can help distinguish legal relationships between drivers operating on different platform modes. Identifying collusion behavior may require abandoning liaison requirements or expanding interpretations based on foreign experiences. Furthermore, allocating legal responsibility should be done reasonably while safeguarding the rights and interests of drivers.
