论政府采购与招标投标的区别——对财政部政府采购指导性案例10号的探讨

On the Difference between Government Procurement and Bidding and Bidding—A Discussion on Government Procurement Guiding Case No. 10 of the Ministry of Finance

摘要: 《政府采购法》与《招标投标法》均为全国人大常委会制定的、规范政府购买货物或服务的法律，但二者在规范主体、规范内容、规范内涵、实施程序等方面存在区别。通过对财政部政府采购第10号指导性案例进行分析，明确招标投标不同于政府采购，本案应适用政府采购法的有关规定。

Abstract: The Government Procurement Law and the Tendering and Bidding Law are both laws formulated by the Standing Committee of the National People’s Congress to regulate the purchase of goods or services by the government. However, there are differences between the two in terms of regulatory subjects, regulatory content, regulatory connotations, and implementation procedures. By analyzing the Guiding Case No. 10 of the Ministry of Finance on Government Procurement, it is clarified that bidding and tendering are different from government procurement, and the relevant provisions of the Government Procurement Law should be applied in this case.
