Legal Supervision of Live Streaming Platforms in the Perspective of the Internet

摘要: 网络直播作为一种新型的社交媒体模式，丰富人们业余生活的同时拉动信息产业的发展。然而，较低的准入门槛、广泛的传播效应，也使网络直播平台内部的法律风险不断衍生。网络直播平台在整个网络直播体系当中处于核心地位，为网络直播提供媒介和技术支持，直播平台理应扮演净化直播空间环境的“守门人”角色。我国早已形成对直播平台进行监管的法律体系，但对直播平台的法律监管仍面临法律法规尚不完善、执法机制运行不畅、程序衔接有待改进、平台义务范围模糊等困境，为此，应健全相关的行政法规、强化相关部门的协调沟通、完善行刑衔接的程序制度、明确网络直播平台的义务范围，以更好地对网络直播平台进行更好地治理，从而净化网络空间环境和维护社会秩序。

Abstract: As a new type of social media model, live streaming not only enriches people’s amateur life but also drives the development of the information industry. However, the low entry threshold and wide dissemination effect also lead to increasing legal risks within the live streaming platform. The live streaming platform is at the core of the entire live streaming system, providing media and technical support for live streaming. The live streaming platform should act as the “gatekeeper” to purify the live streaming space environment. China has already formed a legal system to supervise live streaming platforms, but there are still difficulties in legal supervision of live streaming platforms, such as imperfect laws and regulations, poor operation of law enforcement mechanisms, procedures that need to be improved, and ambiguous scope of platform obligations. Therefore, it is necessary to improve relevant administrative regulations, strengthen coordination and communication between relevant departments, improve the procedural system of administrative and criminal connection, and clarify the obligation scope of the live streaming platform, so as to better manage the live streaming platform, thereby purifying the cyberspace environment and maintaining social order.
