Path Regulation of Personal Information Protection in the Context of E-Commerce

摘要: 大数据时代的到来，放大了个人信息带来的人身价值和财产价值。正因为个人信息带来的巨大利益，在个人信息数据进行收集、分析和处理的过程中，个人信息的侵权层出不穷。电商行业作为大数据时代下的一个缩影，正在迅速发展，作为消费者，在感受电商平台带给自身便利的同时，相伴随而来的是消费者个人信息权益问题日益突出。电商发展势头之所以如此良好，离不开基于大数据技术对于个人信息的利用。电商领域下对于个人信息权益的损害表现多种多样，伴随信息从收集、处理、存储到使用的全过程之中。为此，应结合我国《中华人民共和国民法典》(下简称《民法典》)、《中华人民共和国个人信息保护法》(下简称《个人信息保护法》)等法律有关内容，探索这一背景下个人信息保护的有效路径。

Abstract: The advent of the era of big data has amplified the personal value and property value brought by personal information. Because of the huge benefits brought by personal information, in the process of collecting, analyzing and processing personal information data, the infringement of personal information is endless. As a microcosm in the era of big data, the e-commerce industry is developing rapidly. As consumers, while feeling the convenience brought by the e-commerce platform, the rights and interests of consumers’ personal information are becoming increasingly prominent. The reason why the development momentum of e-commerce is so good is inseparable from the use of personal information based on big data technology. The damage to the rights and interests of personal information in the field of e-commerce is varied, accompanied by the whole process of information collection, processing, storage and use. To this end, we should explore the effective path of personal information protection in this context by combining the relevant contents of China’s Civil Code of the People’s Republic of China (hereinafter referred to as the Civil Code) and the Personal Information Protection Law of the People’s Republic of China (hereinafter referred to as the Personal Information Protection Law).
