电子商务领域中算法歧视的法律规制探析

An Analysis of the Legal Regulation of Algorithmic Discrimination in the Field of E-Commerce

摘要: 在我国当前的数字经济时代背景下，算法歧视规制面临着诸多困境。本文通过分析电子商务由算法歧视所带来的危害，并结合域外法律体系下的回应主要包括欧盟模式的对数据源头的规制和保护，以及将算法责任视为重点的美国模式。提出对我国算法歧视问题规制的路径建议，并结合国内基本国情和现状，对大数据算法歧视问题进行深入探讨和研究，从而期望完善我国电子商务平台算法，以适应数字经济的快速发展和变化。

Abstract: In the current context of the digital economy in China, the regulation of algorithmic discrimination faces numerous challenges. This article analyzes the harm caused by algorithmic discrimination in e-commerce, and combines responses from foreign legal systems, mainly including regulations and protections on data sources based on the European Union model, and the focus on algorithm liability as emphasized by the United States model. By proposing paths for regulating algorithmic discrimination in China, this article conducts in-depth discussions and research on big data algorithmic discrimination issues, combining China’s basic national conditions and current situation, in order to improve China’s e-commerce platform algorithms to adapt to the rapid development and changes of the digital economy.
