我国妇女权益中人身安全保护令的不足与完善

Deficiency and Perfection of Personal Safety Protection Order in Chinese Women’s Rights and Interests

摘要: 《反家庭暴力法》的制定和人身安全保护令的确立，标志着我国反家庭暴力工作实现里程碑式跨越。人身安全保护令的形成经历了相当长的一段时间，其在预防和制止家庭暴力、维护和保障婚姻自由、保持和促进社会稳定方面具有重大意义。不可否认的是，随着司法实践的逐渐深入，这一制度的不足也逐渐显露出来。本文通过归纳分析现行立法的不足，结合司法实践中的问题，对我国人身安全保护令的进一步完善提出合理建议。

Abstract: The establishment of “Anti-Domestic Violence Law” and the establishment of personal safety protection order mark the milestone of China’s anti-domestic violence work. The formation of personal safety protection order has experienced a long period of time, which has great significance in preventing and stopping domestic violence, maintaining and protecting the freedom of marriage, and maintaining and promoting social stability. It is undeniable that with the gradual deepening of judicial practice, the deficiencies of this system are gradually revealed. Through summarizing and analyzing the deficiencies of the current legislation and combining with the problems in judicial practice, this paper puts forward reasonable suggestions for the further improvement of the personal safety protection order in our country.
