电子商务平台中的知识产权侵权问题探究

Research on Intellectual Property Infringement in E-Commerce Platform

摘要: 电子商务平台技术的快速发展不仅带来了快捷的购物形式，同时也带来了知识产权保护的挑战。日益猖獗的知识产权侵权行为不仅给权利人带来了巨大的经济与声誉损失，还阻碍了电子商务平台的发展。故本文提出电子商务领域内的知识产权侵权问题是一个涉及到消费者、权利人和电商平台等多个层面的问题，将对电子商务平台中的知识产权侵权问题现状及其保护中存在的问题进行分析。本文认为从立法、执法、执行多个层面对电子商务平台中的侵权行为进行治理与规范，可以改善电子商务平台中的侵权行为。

Abstract: The rapid development of e-commerce platform technology has not only brought about a fast form of shopping, but also brought challenges to the protection of intellectual property rights. The increasing infringement of intellectual property rights not only brings huge economic and reputational losses to rights holders, but also hinders the development of e-commerce platforms. Therefore, this paper proposes that the issue of intellectual property infringement in the field of e-commerce is an issue involving consumers, rights holders and e-commerce platforms, and will analyze the current situation of intellectual property infringement in e-commerce platforms and the problems existing in their protection. This paper argues that the governance and regulation of infringement in e-commerce platforms from the levels of legislation, law enforcement and enforcement can improve the infringement behavior in e-commerce platforms.
