消费者个人信息保护法律问题的研究——以大数据应用为背景

Research on Legal Issues of Consumer Personal Information Protection—Based on the Background of Big Data Application

摘要: 随着大数据技术的快速发展，个人信息的收集、存储、使用和共享变得更加普遍，同时也带来消费者个人信息保护的法律挑战。本文首先对大数据应用下消费者个人信息进行总结，接着阐述大数据应用下消费者个人信息保护的重要性，并总结大数据应用下消费者个人信息法律保护存在的问题。基于此，从完善立法体系、强化企业责任、畅通救济途径、提升监管能力、增强消费者权利意识以及推动国际合作等方面探讨消费者个人信息法律保护的完善路径，以期为构建更加健全的消费者个人信息保护机制提供理论支持。

Abstract: With the rapid development of big data technology, the collection, storage, use and sharing of personal information has become more common, which also brings legal challenges to the protection of consumers’ personal information. This paper first summarizes consumer personal information under the application of big data, then expounds the importance of consumer personal information protection under the application of big data, and summarizes the problems existing in the legal protection of consumer personal information under the application of big data. Based on this, the paper discusses the perfect path of consumer personal information legal protection from the aspects of improving the legislative system, strengthening corporate responsibility, unblocking relief channels, enhancing supervision capacity, enhancing consumer rights awareness and promoting international cooperation, so as to provide theoretical support for the construction of a more sound consumer personal information protection mechanism.
