网络暴力的法律规制问题研究

摘要: 本文通过分析网络暴力的定义、形式及特点，探讨我国在应对网络暴力时面临的立法、司法和执法困境。研究发现，现行法律在网络暴力治理中存在立法缺漏、法律威慑力不足、责任认定困难、取证困难以及实名制落实不到位等问题。在此基础上，本文建议立法层面制定专门的网络暴力防治法，并加重对网络暴力行为的处罚力度，以增强法律的震慑作用；通过健全实名制、明确网络服务提供者的法律责任以及完善电子证据采集和使用规范，提高司法的有效性和公平性；加强技术保障、隐私保护以及执法部门之间的协同合作，形成高效的网络暴力监管体系，提高执法质量和效能。以期为优化我国网络暴力法律治理方式提供有益参考。

Abstract: This article analyzes the definition, forms, and characteristics of online violence, and explores the legislative, judicial, and enforcement challenges faced by China in responding to online violence. Research has found that there are legislative gaps, insufficient legal deterrence, difficulties in determining responsibility, difficulties in obtaining evidence, and inadequate implementation of real name registration in the governance of online violence in current laws. On this basis, this article suggests that a specialized law on the prevention and control of online violence should be formulated at the legislative level, and the punishment for online violence should be increased to enhance the deterrent effect of the law; by improving the real name system, clarifying the legal responsibilities of network service providers, and improving the norms of electronic evidence collection and use, the effectiveness and fairness of the judiciary can be improved; strengthen technical support, privacy protection, and collaborative cooperation among law enforcement agencies to form an efficient network violence supervision system and improve the quality and efficiency of law enforcement. In order to provide useful references for optimizing the legal governance of online violence in China.
