电子商务领域中网络虚拟财产比较立法研究

Research on Comparative Legislation of Network Virtual Property in Electronic Commerce Field

摘要: 近些年来，随着网络时代的到来和大数据的发展。我们的生活逐渐“网络化、信息化”，可以说我们最基本的生活需求已经注入了大量的电子商务元素，我们的衣食住行都可以在电商领域获得更多的便捷。例如网络购物、美团外卖、网络订酒店、网约车等等。就在人们沉浸在网络所带给我们的种种便利时，网络犹如一把双刃剑，逐渐展现其某些方面所带来的安全隐患。例如我们面临着信息泄露、网络诈骗等新情况，为了保护公民的人身权利和财产权利，世界各国都或多或少在电商领域进行了立法。然而立法是具有滞后性的，且法律不可能涵盖网络中所有方面。其中，网络虚拟财产中的游戏道具价值认定一直是立法的一大难题，本文着手从国内外对电子商务领域中网络游戏道具价值认定的立法进行比较研究，进而对目前立法状况进行深入分析，从而得出相关结论。

Abstract: In recent years, with the advent of the Internet era and the development of big data, our lives are gradually becoming more “networked and informationalized”. It can be said that our most basic life needs have been injected into a large number of e-commerce elements, and our clothing, food, housing and travel can be more convenient in the field of e-commerce, for example, online shopping, Meituan takeout, online hotel booking, online car booking and so on. When people are immersed in the various conveniences brought by the network, the network is like a double-edged sword, gradually showing the security risks brought by some aspects of it. For example, we are faced with information leakage, network fraud and other new situations; in order to protect citizens’ personal rights and property rights, countries around the world have more or less carried out legislation in the field of e-commerce. However, legislation has a lag, and the law cannot cover all aspects of the network. Among them, the identification of network virtual property has always been a big problem in legislation. This paper sets out to conduct a comparative study on the legislation of network virtual property in the field of e-commerce at home and abroad, and then conduct an in-depth analysis of the current legislation situation, so as to draw relevant conclusions.
