摘要: 随着电子商务交易的日益频繁，电子商务平台所涉及的民事责任问题也逐渐凸显。本文深入探讨了电子商务平台民事责任的法律界定，分析了其在不同情境下的责任性质与构成要件，同时，通过考察相关诉讼实践，也进一步揭示了电子商务平台在民事纠纷中的实际法律地位和责任承担情况。在研究过程中，一方面本文进一步细化了电子商务平台民事责任的法律界定，这也是平台在交易中承担义务和责任的法律基础，另一方面，在基于分析电子商务平台民事责任诉讼实践的基础上，本文针对实践中的困境给出了可行的具体对策，从而为电子商务平台的规范运行提供明确指导，为电子商务行业的健康、有序发展提供法律支撑。

Abstract: With the increasing frequency of e-commerce transactions, the civil liability issues involved in e-commerce platforms are gradually becoming prominent. This article delves into the legal definition of civil liability for e-commerce platforms, analyzes their nature and constituent elements of liability in different contexts, and further reveals the actual legal status and liability assumption of e-commerce platforms in civil disputes by examining relevant litigation practices. In the research process, on the one hand, this article further refines the legal definition of civil liability on e-commerce platforms, which is also the legal basis for platforms to assume obligations and responsibilities in transactions. On the other hand, based on the analysis of civil liability litigation practices on e-commerce platforms, this article provides feasible specific countermeasures for practical difficulties, thereby providing a good environment for the standardized operation of e-commerce platforms and legal support for the healthy and orderly development of the e-commerce industry.
