Legal Regulation of Algorithmic Recommendations on Online Platforms in the Digital Age

摘要: 数字时代下，网络平台开始大规模采用算法推荐构建新的商业模式，在提高商业效率、创造更多经济效益的同时，也引发了越来越多的版权侵权问题，传统网络经营模式下的“避风港”规则不能再完全匹配适用当下网络平台的版权侵权纠纷，算法推荐与“技术中立”的内涵背道而驰，因此有必要更新规则内容，完善相关法律规定。本文以算法推荐为基础研究对象，分析当下网络平台的版权注意义务及相应的侵权责任，探索完善网络平台算法推荐的法律规制之路径。

Abstract: In the digital era, network platforms begin to adopt algorithm recommendation to build new business models on a large scale, which not only improves business efficiency and creates more economic benefits, but also causes more and more copyright infringement problems. The “safe haven” rule under the traditional network business model can no longer fully match and apply the current copyright infringement disputes on network platforms. Algorithm recommendation runs counter to the connotation of “technology neutrality”, so it is necessary to update the content of the rules and improve the relevant legal provisions. This paper takes algorithm recommendation as the basic research object, analyzes the copyright duty of care and the corresponding infringement liability of the current network platform, and explores the path to improve the legal regulation of algorithm recommendation of the network platform.
