人工智能生成物著作权可行性分析研究

Feasibility Study of Copyright in Artificial Intelligence Generators

摘要: 当今人工智能技术的迅猛发展，对传统社会市场领域和行业规则带来了巨大改变，其在文学艺术领域也取得了令人惊叹的成就，但是，相关领域的人工智能生成物也给我国现行的著作权法律制度带来了巨大挑战。文章将着重分析人工智能生成物是否可以成为《著作权法》保护客体，论证将人工智能生成物纳入《著作权法》保护的可能性，为我国人工智能生成物提供初步的法律保护。

Abstract: The rapid development of today’s artificial intelligence technology has brought great changes to the traditional social market areas and industry rules, and its achievements in the field of literature and art are also amazing, but the artificial intelligence generated objects in the related fields have also brought great challenges to the existing copyright legal system in China. This paper will focus on analysing whether AI generated objects can be the object of protection under the Copyright Law, arguing the possibility of including AI generated objects into the protection of the Copyright Law, and providing preliminary legal protection for AI generated objects in China.
